New Laws for 2011 in California

(Best Syndication News) There were 725 new laws taking effect on January 1st in California. There are new penalties for sex offenders, regulations on insurance companies and new provisions allowing people to rent out their own car. Possession of small a amount of marijuana was decriminalized.

AB 1844, also known as Chelsea’s Law, increases the penalties for sex offenders. There is also a provision for a “one strike” life without parole sentencing. It is also a misdemeanor for offenders to enter a park where children gather. The law increased the parole term up to ten years from five. Some offenders may be on parole for life.

AB 1871 allows people to rent out their car when they are not using it. There may still be a liability against the car owner for damages even with the proper insurance coverage.

SB 1411 makes it a crime to “maliciously” impersonate someone online using a social network or website. A previous law, written in 1872, outlawed maliciously impersonating someone, but the new law brings the law up to date with social networks. “SB 1411 makes it unlawful to knowingly and without consent credibly impersonate another person through or on an Internet Web site or by other electronic means with the intent to harm, intimidate, threaten or defraud another person.”

SB 1317 will fine parents of K-8 children $2,000 if their children miss 10 percent of the school year without a valid excuse. Parents can also go to prison for one year for the misdemeanor.

SB 1449 makes the procession of an ounce or less of marijuana an infraction. The fine is $100 and the procession is not a criminal offence.

SB 782 is intended to prevent landlords from unfairly evicting tenants who were victims of domestic or sexual abuse or stalking.

AB 119 forces insurance companies to charge the same rate for men and women for identical coverage. The bill modifies the Knox-Keene Health Care Service Plan Act of 1975.
