Officer Involved Shooting was Justified: DA Says

(Best Syndication News) The San Bernardino District Attorney’s office released a statement today saying that the officer involved shooting last year was justified and no charges will be filed against the officer.

Witnesses at the Hide Away Mobile Home Park on Yucaipa Boulevard said they saw a man with a gun. They told police that they spotted a car driving around the park and when they went to investigate a man approached them. After lifting his shirt exposing a weapon, he told the witnesses that he would take care of it, according to Susan Mickey with the San Bernardino’s DA’s office.

Dispatch warned deputies that there were reports of a man with a gun. Deputy Eric Trujillo spotted a suspect on 4th street and went to investigate. The man matched the description provided by witnesses.

Deputy Trujillo said a foot chase ensued until the man stopped under a tree. At that time he told the man to raise his hands. Trujillo told investigators that the man kept his hands low when he turned.

The suspect began turning his right shoulder toward the deputy with his right hand down by his waist. He seemed to be pulling something “shiny (metallic)” from his waist band. Trujillo fired three shots at the man, later identified as Bernardino Calderon.

Hospital toxicology tests showed the presence of amphetamine in Calderon’s blood. Mickey tells Best Syndication that Trujillo feared for his life. “Deputy Eric Trujillo‘s use of deadly force was in response to an apparent and immediate threat of death or great bodily injury,” Mickey said. “The shooting was justifiable in self defense and no criminal liability attached to the conduct of the officer.”

The incident took place at around 10 pm on November 19th 2010.
