Nevada Jury Awards $2.5 Million Medical Malpractice Judgment

The family of Elisa Sanchez was awarded $2.5 million in a http://www.njmedlaw.com/what.html medical malpractice lawsuit involving her doctor’s http://www.njmedlaw.com/cancer.html misdiagnosis of cancer. Her doctor’s negligent actions resulted in delayed treatment and severely reduced her chances of survival.

In 2004, Sanchez, who was 24 years old at the time, went to her doctor after experiencing blood in her stool. Her doctor diagnosed the problem as hemorrhoids on several occasions. However, the actual cause of the problem was http://www.njmedlaw.com/colon-cancer.html colon and rectal cancer.

Due to her doctor’s failure to accurately diagnose her cancer, Sanchez’s condition went untreated for an additional seven months. She eventually died in 2007 at age 27.

Sanchez’s family argued that she would have had a 97% likelihood of survival and recovery if the doctor had properly diagnosed her cancer at the first visit. However, due to the delayed diagnosis, her survival rate reduced to 50%. The jury found that the doctor was negligent in his failure to diagnose Sanchez’s cancer, order tests, or refer her to a proper specialist.

The success of most cancer misdiagnosis lawsuits depends on the plaintiff’s ability to prove that the delayed diagnosis severely inhibited effective treatment. Since the successful treatment of most cancers hinges on early diagnosis and prompt treatment, such a delay can likely prove fatal for the victim.

The $2.5 million verdict was the largest medical malpractice award in Clark County, Nevada since 2004.
