A Bankruptcy automatic stay definition is a temporary evaluation that is put into place automatically once a petition for bankruptcy has been filed by an individual or a company. Once an automatic stay is in place, the order prohibits creditors from taking certain actions against the debtor such as proceeding with lawsuits, attempting to gather debt, initiating foreclosure measures or garnishing wages. While it might seem an automatic stay is unfair to creditors, it actually can result in a more reasonable distribution of bankruptcy assets because an automatic stay prevents a hostile creditor from being able to declare to a large percentage of the person or entitys assets before others have a chance.

The automatic stay goes into effect when you file bankruptcy. The stay prevents creditors and collectors from trying to accumulate debts from you. They cannot call you, send letters, or charge you as long as the automatic stay is in effect.

Question: I walked into Walmart with my wife. I was pushing an empty cart and I slipped on some crushed strawberries in front of the check out lines on the tile. Lawsuit Dismissed Against Eclipse Medical Inc., Employees and Others

VANCOUVER, British Columbia - November 19, 2009 Eclipse Medical Inc. is pleased to announce that the lawsuit by AMS Homecare Inc. filed in December 2007 against it, its employees and others was dismissed by the Supreme Court of British Columbia on October 26, 2009. The Court accepted that despite the demands of the Defendants to proceed, AMS Homecare Inc. had done nothing to advance the claims made against any of the Defendants and the case therefore deserved to be dismissed for want of prosecution. Each of the Defendants has been awarded their costs.

Mr. Jason Weinstein, General Manager of Eclipse Medical Inc. said that while the company and the employees are relieved to finally have had the claims dismissed, they are disappointed that they never had the chance to be exonerated by the Court as there was never any merit to the allegations being made. Eclipse Medical Inc. was sued by AMS Homecare Inc. after Eclipse Medical Inc. had successfully purchased the assets of a bankrupt subsidiary of AMS Homecare Inc. from the Trustee in Bankruptcy.

Insurance companies are notorious for looking for a way to deny or underpay claims, putting their own interests before the interests of the insured. This is not acting in good faith.

Teachers want Retirement Fund Debt Paid Off

[Best Syndication News] The state has been writing IOUs to the teachers’ pension fund for the past six years to cover retirees’ health insurance costs, and officials are increasingly worried that it won’t ever be able to pay up. So the Kentucky Teachers’ Retirement System has launched a push to get the state to pay off its $521 million debt to the roughly $15 billion system and find a sustainable way to pay for retired teachers’ health insurance in the future.

“I’m suggesting that we put a plan in place this session … and it’s one that can be stuck to,” KTRS Executive Director Gary Harbin said. “As soon as the economy turns around there’s going to be a thousand worthwhile projects out there, but they’ve got this obligation to teachers … that needs to be met first.”

Since fiscal 2005, the legislature has been redirecting millions of dollars each year from the teachers’ pension fund to the retirees’ medical insurance fund, with a promise of repaying the money at a 7.5 percent interest rate.
